Terms of Service
These terms govern use of Filmclusive, including accounts, uploads, imported contacts, public sharing, payments, connected services, and dispute or misuse handling.
These terms apply to Filmclusive websites, applications, connected services, and features that link to this page. If you do not agree, do not use the service.
Using Filmclusive
You may use Filmclusive only in compliance with these terms and applicable law. You are responsible for activity that occurs under your account, for keeping your credentials secure, and for making sure the information you provide is accurate and current.
We may suspend, restrict, or terminate access if we believe an account, upload, or workflow violates these terms, creates legal risk, threatens platform security, or harms other users.
If you use Filmclusive for a team, client, production, organization, or minor participant, you represent that you have the authority to act for that person or entity in the parts of the service you control.
Your content and your rights
You keep ownership of the content you submit to Filmclusive, subject to the rights needed for us to host, process, store, copy, transmit, display, and make that content available as required to operate the service you chose to use.
That license includes use by our hosting, storage, search, analytics, email, payment, AI, speech, and integration providers acting on our behalf. It also includes sharing with other users or the public when that is the direct result of your chosen settings, links, team workflows, public profile settings, event participation, or similar actions.
You are responsible for keeping your own backup copies of material that matters to you. Filmclusive is not an archival preservation service and does not promise permanent retention of every file, message, submission, or generated output.
Uploads, imported contacts, and third-party data
You represent and warrant that you have the necessary rights, permissions, and legal basis to upload, import, store, send, or otherwise use any content or personal information you provide through Filmclusive.
If you import bulk contacts, upload call sheets, connect Google, or otherwise submit information about other people, you are responsible for that decision and for the legality of that data use. This includes names, photos, emails, phone numbers, social handles, notes, classifications, and any other imported or enriched contact details.
You may not use Filmclusive to unlawfully surveil, scrape, spam, impersonate, harass, defame, violate publicity or privacy rights, or distribute content you do not have the right to share.
You may not upload malware, exploit code, credentials, payment-card data, Social Security numbers, passport data, full tax forms, or other highly sensitive material unless the applicable workflow clearly requires it and you accept responsibility for that submission.
Public profiles, links, and collaboration tools
Some Filmclusive features are designed to share information with collaborators, clients, organizers, applicants, or public visitors. If you make content public or send a share link, you are responsible for understanding that the recipient may be able to view, copy, or act on the information made available through that feature.
Privacy settings, approval flows, and share-link controls can reduce exposure, but they do not eliminate the risk that a recipient may retain or redistribute information that was legitimately disclosed to them.
Payments and billing
Paid features, subscriptions, ticketing, donations, or related billing workflows may be processed by Stripe and other payment-service providers. By starting a paid workflow, you agree to the applicable pricing, billing cadence, taxes, fees, and payment-processor terms presented to you at checkout.
We may store customer, subscription, transaction, invoice, usage, and billing metadata needed to administer those features, prevent fraud, and maintain accounting records.
Some recurring plans may renew until canceled through the applicable billing interface or payment provider. Failed payments, chargebacks, refunds, or canceled subscriptions may limit access to the affected feature, storage, credits, audio minutes, tickets, or related entitlements.
Refunds, cancellation windows, and payout timing may vary by workflow. A creator-set refund policy, booking refund window, event policy, donation flow, or checkout disclosure presented in the applicable product flow controls that transaction when it is more specific than these general terms.
AI, speech, and connected services
Some Filmclusive features use third-party AI, speech, email, calendar, or contact providers. When you choose those features, you authorize Filmclusive to send the necessary content and metadata to the provider required to complete the request.
AI and transcription outputs may be inaccurate, incomplete, or inappropriate for your intended use. You are responsible for reviewing and validating outputs before relying on them.
Filmclusive does not provide legal, tax, accounting, employment, permitting, safety, medical, or other regulated professional advice. Templates, AI outputs, scheduling tools, and workflow suggestions are operational tools only.
Intellectual property and complaints
You may not upload or distribute content that infringes copyright, trademark, publicity, privacy, or other proprietary rights. We may remove content, disable links, or restrict accounts when we receive a complaint or believe a violation may have occurred.
Copyright, IP, privacy, or impersonation complaints can be sent to privacy@filmclusive.com with enough detail for us to investigate, including the claimant identity, the affected content, the basis of the complaint, and the requested action.
Acceptable use and enforcement
You may not use Filmclusive to stalk, discriminate against, exploit, or deceive other people; to send unlawful bulk communications; to collect data without permission; to interfere with security controls; or to test, reverse engineer, or access non-public parts of the service except as allowed by law and by our written permission.
We may investigate misuse, preserve evidence, disable content, revoke links, block imports or communications, and cooperate with law enforcement or rights holders when we believe that is reasonably necessary.
Availability, security, and risk
Filmclusive is provided on an as-is and as-available basis. We do not guarantee uninterrupted service, permanent availability of any feature, or that every workflow will remain identical over time.
No online service can guarantee absolute security. You should not upload material that you cannot afford to expose, lose, or delay unless the workflow requires it and you accept the operational risk of online storage and transmission.
Limitation of liability
To the maximum extent permitted by law, Filmclusive and its operators are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data loss, business interruption, reputational harm, or losses caused by third-party conduct, unauthorized access, outages, or integration failures.
Nothing in these terms limits liability where the law does not allow that limitation.
Indemnity
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Filmclusive and its operators from claims, liabilities, damages, judgments, losses, and expenses arising out of your content, your imports, your use of the service, your violation of these terms, or your violation of another person's rights.
Privacy and deletion
Your use of Filmclusive is also governed by our Privacy Policy, Cookie Policy, and Do Not Sell or Share page.
Account deletion currently supports a scheduled 24-hour deletion option and, in some cases, immediate deletion. Some legal, security, audit, or fraud-prevention records may be retained even after account deletion.
Children and minors
Filmclusive is not intended for children under 13. If you use Filmclusive on behalf of a minor or with a minor participant, you are responsible for having the authority and permissions required for that use.
Disputes and additional terms
If you have a dispute with Filmclusive, contact us first so we can try to resolve it informally. Some features, campaigns, teams, organizers, service providers, or separately negotiated relationships may also present additional terms, refund rules, or order-form terms that apply to that specific workflow.
If a specific product flow, written agreement, or posted event or service policy conflicts with these general terms, the more specific terms control for that workflow.
Changes and contact
We may update these terms as the product changes. Continued use after updated terms become effective means you accept the revised terms.
